The Customer is NOT Always Right
One employer was reminded of this when the EEOC alleged it discriminated based on race to acquiesced to patients’ preferences for care providers based on race and national origin. Non-preferred health care aides would be transferred to a new assignment or, if no other assignment was available, lose their employment completely.
The lawsuit was settled to the tune of $400,000. But like some other headlines this month and as is so frequently the case, it is not just about the money. This employer will also (1) update its internal policies; (2) provide mandatory training for management employees about Title VII; and (3) report complaints to the EEOC.
Consider this advice. The EEOC writes, “It is imperative for employers to have policies, training, and other safeguards in place that help prevent a client’s prejudices from influencing their employment decisions.”
