Federal Forms & Figures Awaiting Updates: FMLA, Form I-9, VEVRAA Benchmark
What’s up? Have you noticed one or more federal forms and figures have expired or are about to?
- FMLA – all five (5) forms and four (4) notices have an expiration date of June 30, 2026. The DOL FMLA Forms webpage reads, ” The expiration date of the DOL forms has passed, are they still effective? Yes. The content of the information contained within the optional-use DOL form is still applicable, regardless of the expiration date. The expiration date on the DOL forms is related to the collection of information as required by the Office of Management and Budget (OMB), and not relevant to the content of the required information.”
- Form I-9 – Three forms are currently in play, and it depends upon whether you are using a paper or electronic version.
- If you are using the paper form, there are two versions with an edition date of 08/01/23. One has an expiration date of 07/31/26. On August 1st, you should begin using the other form with the same edition date but an expiration date of 5/31/27.
- If you are using the electronic version, U.S. CIS’ Form I-9 webpage (see “Edition Date”) explains that you should use the version that has the issue date of 01/20/25 and an expiration date of 05/31/2027.
For Covered Government Contractors:
- VEVRAA Benchmark – if you are a covered federal contractor required to maintain written affirmative action plans for veterans, you may have noticed this benchmark for utilization of protected veterans in your workforce published on July 30, 2025, is now more than one year old. While there is no expiration date per se, the figure has historically been updated annually. Although, the March 31, 2024, figure was not updated until 16 months later on July 29, 2025.
- Voluntary Self-Identification of Disability Form – this form also expired as of June 30, 2026. As previously reported, this is the 2nd recent expiration. OFCCP’s webpage reads, “The OMB date on some forms may be expired. However, the forms are still valid for use while the information collection is under review by OMB.”
