On December 9th, the U.S. Department of Labor published its Fall 2021 regulatory agenda announcing that this Spring it may publish a proposed rule to “update the salary level requirement” for properly classifying an employee as exempt under the Fair Labor Standards Act (FLSA).
Before and since, there has been no shortage of legislation and court cases addressing wage and hour violations under the FLSA, state, and local laws.
