Last year age discrimination charges hit their 2nd highest level since 1997. On March 13, 2012 Congress introduced the “Protecting Olders Worker Against Discrimination Act.” Then just 16 days later the U.S. EEOC announced its publication of a final rule on “Reasonable Factors Other Than Age” (RFOA) and clarified that the ADEA prohibits policies and practices that have the effect of harming older individuals more than younger individuals, unless the employer can show that the policy or practice is based on RFOA.
