OFCCP’s Update to Voluntary Self-Identification of Disability Form Still Pending
If you are a federal (sub)contractor with written affirmative action plan requirements, you may have noticed the voluntary self-identification of disability form expired April 30th. On May 1st, the OFCCP published a new form with the expiration updated by just 31 days to May 31st. As of this writing, the new form has not yet been published.
What’s the delay? Last summer the OFCCP published a notice of proposed rulemaking. Some of the questions they asked were about:
- eliminating the requirements for covered contractors to invite applicants or employees to voluntarily self-identify as being an individual with a disability;
- removing the annual utilization benchmark; and
- suspending the requirement to conduct annual assessments of utilization rates or results of outreach.
The contents of new form may depend upon the OFCCP’s final rule related to any of the above. Stay tuned. In the interim, the OFCCP’s webpage reads, “The OMB date on some forms may be expired. However, the forms are still valid for use while the information collection is under review by OMB.” You may want to bookmark that page and check back periodically for updates.
