EEOC Issues Updated Guidance on National Origin Discrimination

Today, the EEOC announced the release of new and updated educational materials reaffirming Chair Andrea Lucas’ commitment to advancing robust enforcement and awareness around national origin discrimination and Anti-American bias.  The agency reminds us that Title VII’s protections apply equally to all racial, ethnic, and national origin groups. This can include preferring foreign workers, including workers with a particular visa status, over American workers.

Some examples include:

  • Discriminatory job ads that prefer or require applicants from a particular country or with a particular visa status (for example, “H-1B preferred” or “H-1B only”).
  • Harassment, discrimination, or retaliation based on national origin or engaging in a legally protected activity.
  • Using business considerations such as acquiescing to customer or client preferences, or realizing lower labor costs when hiring certain visa-holders does not excuse an employer’s decision to hire foreign workers over American workers.
