NLRB Delays Effective Date for Joint Employer Rule

If this does not ring a bell, check out the October 27th news story. The National Labor Relations Board’s final rule, “Standard for Determining Joint Employer Status” was scheduled to take effect December 26, 2023.

On November 16th, the Board announced it was “extending” the effective date to February 26, 2024.

Why? The Board explains the purpose is “to facilitate resolution of legal challenges with respect to the rule.”

What’s that about? The U.S. Chamber of Commerce announced that on November 9, 2023, that they filed suit alleging the NLRB’s rule was “arbitrary [and] capricious.”
