EEOC Publishes “Workplace Guidance on Harassment Prevention”
On April 29th, the U.S. EEOC published its latest guidance on workplace harassment. This Guidance updates, consolidates, and replaces the agency’s five guidance documents issued between 1987 and 1999, and serves as a single, unified agency resource on EEOC-enforced workplace harassment law. You might remember reading that the Commission posted its preliminary Guidance for public comment last October 2023. The Commission received approximately 38,000 comments, including this author’s.
What are some highlights of the final Guidance?
- Social media is mentioned at least 19 times;
- Misgendering is mentioned nine (9) times;
- Non-working time and places are referenced more than 20 times;
- Other topics include harassment of and by third parties, indirect and unintentional harassment, and more.
