Up in Smoke: Cannabis, Substance Use, Abuse, & the Workplace
On May 16th, the U.S. Department of Justice announced that the Attorney General has submitted to the Federal Register a notice of proposed rulemaking initiating a formal rulemaking process to consider moving marijuana from a schedule I to schedule III drug under the Controlled Substances Act (CSA). The final rule was published in the Federal Register on May 21st. What does that mean for employers? This program will provide updates on this, other federal and state rules and trends related to:
- substance testing of applicants and employees,
- assessing under the influence v. fitness for duty,
- when to take adverse employment action based on positive test results, obligations to provide reasonable accommodation,
- and more.
