Sex Discrimination & Harassment: The Continuing Evolution
The demographics of sex discrimination have been changing for decades. In 1998, the U.S. Supreme Court addressed whether same sex harassment was actionable. Twenty-five years later, we are still managing issues related to actual or perceived harassment, discrimination, and bullying of individuals based on their sex, sexual orientation, gender identity, and more.
On July 17th, Texas became the 15th state to at least temporarily block implementation of Title IX’s final rule published in June 2023. The rule covers academic institutions that receive federal funds and requires them to accommodate biological men on women’s sports teams, including use of associated facilities such as bathrooms, showers, and locker rooms.
In April 2024, the U.S. EEOC issued updated Enforcement Guidance on Workplace Harassment including based on sex, sexual orientation, gender identity, and stereotyping. This program will address the latest tips from the EEOC’s guidance; trends from federal, state, and local perspectives; EEOC statistics; recent case studies, and more.
