Are You My Employer? (Re)Defining Employer/Employee Relationships

On January 5th, the U.S. Department of Labor published an opinion letter addressing factors an employer should consider when classifying a worker as a volunteer, as well as determining if two entities that share a worker are joint employers.

On the same date, the DOL issued a Field Assistance Bulletin announcing new factors employers should consider to determine whether an intern or student is, in fact, an employee or may be unpaid.

And since the DOL withdrew the prior Administration’s rules on independent contractor and joint employer status, the courts, Congress and state legislatures have stepped in to provide clarification (or muddy the waters).
